English (EN) LICENSE AGREEMENT FOR END-user - LICENSE FOR PERSONAL USE
License of Use for springs, files, gallery, exercises, diagrams and all work products with GESTICS (Graphics Sports Training Exercises - Coaching System Images)
This agreement is enforceable like any written agreement negotiated and signed by the parties. Please read this agreement carefully before installing and using the software. This agreement also contains information on the Limited Warranty and Limitation of Liability. By installing and using the software you agree to all the terms and conditions of this contract.
This software is licensed exclusively to a user. Until the user abides by the terms of this License Agreement, Gianpaolo Lucatti (the "producer") grants an exclusive license to install the software and use it for the production of exercises, sports drills, practice sports, prints and other reproductions for their own use.
This document sets out the terms under which users of GESTICS may exercise the right to use the original images, assembled, downloaded or produced by means of this gallery
GESTICS is an archive of images produced and assembled by Gianpaolo Lucatti, original and copyright, born from the passion for the sport in general, volleyball, gymnastics, football, fun motor for the activity, and so on. All graphics that are included in the software are original and protected by copyright and may only be used with the software.
This License Agreement is of use to be considered applicable to all the original files, assembled, downloaded or produced by means of this gallery.

INTRODUCTION
Accepting the License of use, the customer, or Private Company, accepts all the terms of this Agreement and agree to be bound by its terms; otherwise you may not use this material.
This License of Use is personal and is not transferable by the petitioner without the prior written consent of Gianpaolo Lucatti.

USES PERMITTED BY THE LICENSE OF USE
The use of the material in this gallery is permitted only under personal use and for the production of exercises, sports drills, practice sports, prints and other reproductions, but only for personal use only, not for resale, from grant licensed or otherwise distribute; The material produced through this gallery, the original files, assembled, downloaded or processed, can not be published or redistributed in any form, neither paper nor computer, nor otherwise.

USES NOT PERMITTED BY THE LICENSE OF USE
We do not allow all uses other than those described in the previous paragraph (permitted uses).
They are also considered explicitly uses not permitted:
1 - Use this software for commercial purposes. For example, you can not sell, rent, lease, sublicense or authorize all or any portion of the software, even and especially about the graphics produced by the software.
2 - reuse of the original images, assembled or produced with GESTICS for commercial purposes, and its reuse in any website or electronic medium or media through traditional publishing means; that the protection of rights.
3 - use the images in a way that is reasonably considered by the author or by the law as pornographic, obscene, immoral, offender, defamatory or libelous, or that might reasonably bring discredit upon the person or property depicted in the images themselves.
This License of Use will remain in force until terminated. The agreement will not be valid without the need for any communication by Gianpaolo Lucatti, if at any time you do not have complied with the terms thereof, Gianpaolo Lucatti reserves the right to decide at any time to revoke or modify the License of Use; these changes will be published in the next version of the gallery GESTICS.
Gianpaolo Lucatti reserves the right to remove or replace for any reason the images of the gallery with other options; License images will be replaced immediate term for each image is no longer in existence, and this License will automatically be applied to the replacement images.
LIMITS AND WARRANTIES OF CONTENTS OF THE IMAGES PROVIDED AND RESPONSIBILITIES
The Customer accept the payment and the responsibility of every sales tax, any tax of Use, of any additional tax value and any costs imposed by the jurisdiction responsible for following the license afforded to him or his exploitation of the images of the gallery, in accordance with this License Agreement.
Gianpaolo Lucatti shall diligently to organize images correctly, but in no case can be a guarantor of the accuracy of the information contained in them.
Gianpaolo Lucatti not guarantee ne' assumes no responsibility that the images in the gallery meet the customer's requirements or that their use will be uninterrupted or that it is error-free.
In no event Gianpaolo Lucatti or other suppliers be liable for any damages, claims or costs whatsoever or events consequential, incidental, indirect, or any lost profits or savings or for any claim by a third party. The entire risk as to the quality and effectiveness of the software and the images will be charged to the customer.
The warranty and liability of the manufacturer or software supplier, in connection with this Agreement shall be limited to the amount you paid for the software, if any.
If the images to be faulty, l'utilizzatore (and not Gianpaolo Lucatti) will assume the full risk and all costs necessary to bring the debt adjustments.
Full responsibility for Gianpaolo Lucatti and actions that the customer may take with respect to any dispute relating to the use of the images will be so regulated as follows:
USE OF IMAGES
L'utilizzatore accepts payment in the amounts set Gianpaolo Lucatti to cover expenses for the use of staff and use of the images created by Gianpaolo Lucatti, including any shipping fees and any sales tax established by law.
If any provision, or portion thereof, of this License Agreement, was wholly or partially unenforceable, or in the event the parties can not come to an agreement, any dispute will be settled by the Court of Siena.
This License of Use shall be governed by Italian law and by the European Union applicable in this regard. They are therefore excluded the rights of the United Nations. This agreement will not be governed by the conflict of laws of any jurisdiction or the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.
ACCEPTANCE
L'utilizzatore acknowledge you have read this License of Use, and that you have understood.
Since Gianpaolo Lucatti agrees to provide the images in the gallery GESTICS, l'utilizzatore commits itself to accept the terms and conditions of this agreement.
The customer also recognizes that the complete and exclusive statement of acceptance of the agreement between himself and Gianpaolo Lucatti supersedes any other clause or any prior agreement, oral or written, and any other communication between he and Gianpaolo Lucatti concerning the content of this License of use.
